The law protects the relationship between a client and a psychotherapist, and information cannot be disclosed without written permission.

HIPPA Privacy Notification: Mr. Heard's practice is compliant with the Electronic Communications Privacy Act, 18 U.S.C.2510-2521. His secure fax line (501-776-2246) is used to send and receive private patient health information. This fax line meets both the Federal and State Patient Privacy Guidelines.

If a Child Custody Evaluation or Home Study Evaluation is requested, there must be either a court order, or both parents must agree to the custody evaluation in writing. Once this has been arranged, both parents will be seen for an initial meeting to explain the process, fees, and sign necessary paperwork. It may be necessary to review medical, school, and any mental health records. It may also be necessary to visit all potential homes for assessment.

Exceptions include:
  • If there is suspected child, dependant adult or elder abuse, Mr. Heard is required by law to report this to the appropriate authorities immediately.
  • If a client is threatening serious bodily harm to another person(s), Mr. Heard has a duty to inform the intended victim(s). (Tarasoff Duty)
  • If a client intends to harm himself or herself, Mr. Heard will make every effort to enlist their cooperation in insuring their safety. If they do not cooperate, Mr. Heard will take further measures without their permission that are provided to him by law in order to ensure their safety.
